Definitions

  • “Customer or You, Your” means the individual accessing or using our Website and purchasing goods and/or services, or the company, or other legal entity on behalf of which such individual is accessing or using the services, as applicable.
  • “Moon Kids/We, or Us” means Moon Kids Furniture Manufacturing LLC SPC and Mazoon Decor- L.L.C – S.P.C – the companies providing the goods and services and the companies that maintain the websites www.moonkids.ae, www.moonkidshome.com, and www.moonkidshome.ae (either together or individually referenced as “Website”).
  • “Product(s)” means the goods and services provided for sale by Moon Kids, the details of which are comprised on the Website

Use of the Website

  • These terms and conditions govern the use of the Website and the purchase of Products on it (hereinafter referred to as the “Conditions”). We urge you to read the Conditions and the Privacy Policy, available on the Carefully review the website before using it.
  • When you use this Website and place orders through it, you agree: to use the Website to make legally valid enquiries and orders only;
    • not to make any false or fraudulent orders. If an order of this type may reasonably be considered to have been placed, we shall be authorized to cancel it and inform the pertinent authorities
    • to provide us with your e-mail address, delivery address, and/or other contact details truthfully and exactly. You also agree that we may use this information to contact you when necessary (see the Privacy Policy). If you do not provide us with all the information we need, you cannot place your order.
  • When you use this Website or place an order on it, you are aware that you are bound by these Conditions, so If you do not agree with all of the Conditions and Privacy Policy, then you must not use the Website.

Purchase conditions

  • Customers ordering through our Website must be a minimum of 18 years of age. It is your responsibility to ensure that the details you provide during your purchase are correct, and you will receive confirmation of the items booked. You should retain a copy of the transaction records and are
    responsible for maintaining the confidentiality of your account.
  • Customers purchasing items on behalf of someone else hereby confirm that you have the authority to bind any business and/or individual on whose behalf you use the Website, and you are responsible for informing them of these Conditions before purchase.
  • If permits, government approvals, or any other 3rd party permits and approval is required to deliver and/or Install your order, then you will be responsible for obtaining such permits.

Payment Options

  • We accept Visa or MasterCard debit and credit cards, or cleared bank transfers will also be accepted for payment.
  • We also engage with the 3rd party instalment payment service providers who will have their own terms and conditions for engagement with their services, separate from Moon Kids.

Refusal or Inability to Process an Order

  • We reserve the right to remove any Product from the Website at any time and to remove or modify any material or content of the Product.
  • Although we will always do everything possible to process all orders, there may be exceptional cases circumstances that force us to refuse to process an order after having sent the confirmation, and we reserve the right the right to do so at any time; in such a case, we will reimburse any amount that you may have paid.
  • Other than reimbursing any amount that you may have paid, we shall not be liable to you or to any third party for removing any Product from the Website or for removing or modifying any material or content from the Website or not processing an order once we have sent the confirmation.

Refund policy

  • All Moon Kids Products are made to order and customized to our Customers’ specifications. Therefore, we do not offer any refunds on products — all sales are final.
  • However, if you encounter an issue with an item that you believe may have a fault, please contact us immediately, and we will work to rectify any problems.
  • Design Service fees are non-refundable.

Changes to Your Order

  • Please ensure that you double-check all custom order details before submitting them to us and making payment. Any changes to your order after production has started or completed will be subject to additional charges.

Delivery

  • We will endeavour to send the order consisting of the product(s) listed in each order confirmation before the date indicated or, if no delivery date is specified, in the estimated timeframe indicated when selecting the delivery method. If there are delays for reasons such as the customization of products, the occurrence
    of unforeseen circumstances or the delivery zone, and we are unable to comply with the delivery date, we will inform you of that situation, and we will give you the option to continue with the purchase, establishing a new delivery date, or cancel the order with full reimbursement of the amount paid.

Inability to deliver

  • If we can’t deliver your order, on your instructions, we will attempt to find a safe place to leave it (if the type of Product is capable of being left). If we cannot find a safe place or your order is not suitable to do so, your order will be returned to our warehouse.
  • If you will not be at the place of delivery at the agreed time, we ask you to contact us 24 hours in advance to Organise delivery on another day; otherwise, there may be an additional delivery charge levied.

Receiving Your Order

  • When Your Products are delivered, please inspect the item(s) immediately upon arrival. This allows any issues to be addressed promptly. While we take care to protect items during transportation, accidents can happen. If you notice any problems, get in touch with us as soon as possible. We may ask you to provide a picture of the suspected fault so our team can assess and resolve the issue.

Storage

  • We do not store items after the production and delivery date has been communicated to you. If you do not facilitate the delivery of your purchased items once they are ready. Storage fees may apply.

Product Information

  • We strive to display as accurately as possible the colours, features, specifications, and details of the Products available on the Website. However, due to it being digital images, the photo effects and brightness in the photos may not reflect the exact colour of the product.
  • The Nature of Wood Products – Many of our Products at Moon Kids are crafted from wood, a natural material that varies in grain and colour. Natural wood products are unique, so even pieces of the same design may differ in appearance. Knots, variations in grain, and colour differences are part of the natural charm of solid wood and are not considered faults. Additionally, outdoor wooden furniture is subject to movement, expansion, and contraction due to weather changes. Small cracks and shifts are a natural part of the wood’s aging process and are expected and are not considered defective items.

Warranty & Defective Items

  • Most of our Products come with a 12 (twelve) month manufacturer’s warranty (excluding some of the small products).
  • In the case of a manufacturing defect with any Product under warranty, we will attempt to repair the item if feasible.
  • If repair is not possible, we will replace the Product per the terms of the warranty.
  • Items with a defect may be repaired, returned, or exchanged if the defect is not caused by misuse or failure to follow care instructions.

Health & Safety

  • Customers must follow all safety guidelines set out in the Website when using our Products.
  • Our Products are made to order and compliant with industry best practice safety standards; however, if You require additional governmental 3rd party safety inspection approval, You must inform us to arrange for these approvals and You agree to be responsible for the costs of these external inspection approvals.

Liability and Limitation of Liability

  • Under no circumstances and under no legal or equitable theory, whether in tort, contract, strict liability or otherwise, shall Moon Kids or any of its affiliates, employees, directors, officers, agents, vendors or suppliers be liable to You or to any other person for any indirect, special, incidental or consequential losses or damages of any nature, including, without limitation, damages for lost profits or contracts, loss of goodwill, loss of data, loss of data, loss of management time or work stoppage, business interruption, accuracy of results, or computer failure or malfunction, even if an authorised representative of Moon Kids has been advised of or should have known of the possibility of such damages, arising out of or in connection with (i) the use of or inability to use the Moon Kids ’s Website; (ii) Your use of or reliance on the Website, any information, hyperlinks or content contained therein, or services included on or otherwise made available to You through the Website; (iii) Your provision of information, personal or otherwise, to Moon Kids; (iv) the provision of services by Moon Kids; or (v) acts or negligence on the part of Moon Kids (vi) any third party advertisement on the Website.
  • In no event will Moon Kids be liable for any damages in excess of the amount paid by You towards the price of the Product in respect to which the claim arose. You hereby release us from any and all obligations, liabilities and claims in excess of this limitation.
  • Moon Kids is not liable for any injuries, resulting health conditions and/or medical emergencies which You may sustain from the use (or misuse) of our Products.
  • Notwithstanding the above, our liability shall not be waived in any case in which it is illegal to exclude our liability.

Indemnity

  • By using the Website, You agree, to the fullest extent permitted by law, to indemnify and hold Moon Kids, its directors, officers, employees, affiliates, agents, contractors, and licensors harmless with respect to any claims arising out of Your breach of these Conditions, Your use of the Website or any of the goods and services, Your non-compliance with applicable laws or regulations in the jurisdiction in which You are accessing the Website or the goods and services, or any action taken by Moon Kids as part of its investigation of a suspected violation of these Conditions or as a result of its finding or decision that a violation of these Conditions has occurred.
  • You agree to defend, indemnify and hold harmless Moon Kids, its affiliates and agents from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to Your use of the Website or any breach by You of these Conditions.

Force Majeure

  • Moon Kids shall be not held liable for any delay or failure in performance of any part of these Terms from any cause beyond our control and without our fault or negligence, such as acts of God, acts of civil or military authority, royal decree, current laws and regulations and changes thereto, embargoes, pandemic or epidemics, war, terrorist acts, riots, insurrections, fires, explosions, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, political unrest, other major environmental disturbances, unusually severe weather conditions, acts of hackers and other illegal activities of third parties, inability to secure products or services of other persons or transportation facilities, or acts or omissions of transportation or telecommunications common carriers or acts, omissions, overloading or slowdowns over the Internet or any third party Internet service providers

Intellectual Property

  • All content, trademarks, logos, product designs, and intellectual property displayed on the Website are the exclusive property of Moon Kids, or their respective owners.
  • Moon Kids is the owner of all intellectual property rights relating to any images used by it. You may not, under any circumstances, reproduce, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way, all or part of the Moon Kids website or any of its social media content without the prior written permission of Moon Kids.
  • You recognize and agree that all copyrights, registered trademarks and other intellectual and industrial property rights to the materials or contents provided as part of the website belong at all times to the Moon Kids group or to a third party who has authorized the use of said content or material to the Moon Kids group.

Governing Law and Legal Effect

  • The parties acknowledge that this agreement shall be governed by the laws of the Emirate of Abu Dhabi and the Federal Laws of the UAE as interpreted in the Emirate of Abu Dhabi.
  • Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE as interpreted in the Emirate of Abu Dhabi.
  • You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between You and Moon Kids as a result of Your use of the Website.
  • If any part of these Conditions is declared illegal or becomes unenforceable, the remaining terms will not be affected and will continue to be in force.
  • You may not transfer the rights and obligations under these Conditions.
  • Moon Kids may transfer, subcontract or assign our rights and obligations at any time.
  • These Conditions may be modified. It is Your responsibility to read them periodically, as the current Conditions at the time of purchase of our Products or use of the Website shall be those that apply.
